British Columbia

Training is mandatory! Under the OHS Provisions of the Workers Compensation Act, BC employers must ensure the health and safety of all workers, and must provide to the employer’s workers “the information, instruction, training and supervision necessary to ensure the health and safety of those workers in carrying out their work and to ensure the health and safety of other workers at the workplace.”

Under the BC Human Rights Code, an employee has a right to be free from discrimination on the basis of sex (section 13(1)). Sexual harassment is a form of discrimination on the basis of sex. An employee can make an application to the Human Rights Tribunal of British Columbia for a monetary remedy for general damages and lost wages. The Tribunal can also decide if a corporation is liable eg. for a failure to investigate.

WorkSafeBC administers the Worker’s Compensation Act, and its policies detail employers’ legal obligations such as having policies, training and complaint procedures to address workplace harassment.
